Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the mobile applications, websites, and related services (collectively, the “Services”) provided by Raci Games Bilisim Teknolojileri Limited Sirketi (“Raci Games”, “we”, “us”), including the Enhance My Photo AI application (the “App”). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

Enhance My Photo AI lets you upload photos and apply AI-powered effects such as enhancement, restoration, colorization, and stylization. Processing is performed by automated artificial-intelligence systems, which may involve third-party processing providers acting on our behalf. How we handle personal data is described in our Privacy Policy, which forms part of these Terms.

2. Eligibility and Accounts

You must be at least 13 years old to use the Services. You may use the App as a guest or create an account. You are responsible for your account credentials and for all activity under your account. You may delete your account at any time from Settings → Delete account inside the App; deletion is permanent and removes your account data, processing history, and remaining credits.

3. Your Content

You retain all rights to the photos you upload (“User Content”). By using the Services, you grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce, and modify your User Content solely to operate and provide the Services (including transmitting it to our AI-processing and storage providers) and to display the results back to you. This license ends when the relevant content is deleted from the Services, except where retention is required by law.

You represent that you own or have the necessary rights to any photo you upload, including the consent of identifiable persons appearing in it.

4. Acceptable Use

You agree not to:

  • upload content that is unlawful, defamatory, harassing, or that infringes the rights (including privacy, publicity, and intellectual-property rights) of others;
  • upload or generate sexually explicit content, or any content that exploits or endangers minors;
  • use the Services to create misleading or deceptive depictions of real persons without authorization;
  • reverse engineer, scrape, overload, or interfere with the Services, or circumvent usage limits or security measures;
  • use the Services in violation of applicable law.

We may remove content and suspend or terminate access for violations of this section.

5. Credits and Subscriptions

Some features consume in-app credits (“coins”) and some features require a paid PRO subscription. Purchases and subscriptions are processed by the app store from which you downloaded the App (Google Play or Apple App Store) and are subject to that store’s payment and refund policies. Subscriptions renew automatically unless cancelled in your store account settings before the end of the current period. Credits have no monetary value, are non-transferable, and are not redeemable for cash; unused credits are forfeited when your account is deleted.

6. AI Output

AI-generated results are produced by automated systems and may be inaccurate, contain artifacts, or differ from your expectations. Results are provided “as is”, and we do not guarantee any particular quality or outcome. You are responsible for how you use the resulting images.

7. Intellectual Property

The Services, including software, design, trademarks, and content other than User Content, are owned by Raci Games or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your own devices for personal, non-commercial purposes.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Raci Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of or related to your use of the Services. Our total liability for all claims relating to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or where required by law. Sections that by their nature should survive termination (including Sections 3, 6–9, and 12) survive.

11. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. Material changes will be announced through the Services or this page, and the “Last updated” date will be revised. Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of Istanbul (Anadolu) shall have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.

13. App Store Terms

If you downloaded the App from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement applies to the extent these Terms are less restrictive, and Apple has no obligation to provide support or maintenance for the App. Google Play purchases are additionally subject to Google Play’s Terms of Service.
